[Journal Article] B型肝炎訴訟追加給付金の資力発生時期 B型肝炎訴訟和解後(和解時点では無症候キャリア)に生活保護が開始され、その後病態悪化により慢性肝炎に至った請求人に対して、生活保護法63条による費用返還は和解時点からではなく慢性肝炎診断時点からだとして、和解時点まで遡って保護開始以降の保護費全額を返還請求した原処分と原裁決を取消した例(平成28年9月23日厚生労働大臣裁決)2017
